In December 2004, 40 states approved a settlement with UnumProvident Corp., that required the company to reevaluate over 200,000 claims and pay a $15 million fine. The settlement came after an extensive multistate investigation of Unum’s claim handling policies.
The settlement required Unum to notify affected policyholders within 15 days of the signed agreement. Failure to do so required the company to pay a $145 million fine. Policyholders of several Unum affiliated companies were affected, including: Unum Life Insurance Co. of America, Paul Revere Life Insurance Co., Unum National Insurance Co., and Provident Life and Accident Insurance Co.
The investigation began in 2003 after insurance commissioners in many states received numerous consumer complaints. Georgia's insurance commissioner, John Oxendine, in March 2003 imposed a $1 million fine on UnumProvident and its subsidiaries over the claim payment issue. Flowers has said investigators saw a "lack of diligence in the claims personnel'' and insufficient training.
The investigation revealed that since 1995, Unum and its subsidiaries have engaged in the practice of terminating and denying legitimate disability claims. It is alleged that the company routinely set monthly financial targets and that employees were given financial incentives for not approving claims. It was also alleged that Unum used biased medical reports, destroyed certain information that would help policyholders and regularly misrepresented the terms of disability policies.
